ARTICLE 1: GENERALITIES

RX France, a company registered in the Nanterre Trade and Corporate Register under number 410.219.364 with head office at 52-54 Quai de Dion Bouton 92806 PUTEAUX – France is organising a Instagram contest code-named “SeaSail&fun” from 01/08/2021 to 31/08/2021 at 01:00 pm.

 

ARTICLE 2: PARTICIPATION REQUIREMENTS

 

The contest shall be open to persons of full age residing in Metropolitan France, excluding staff members, company managers, vendors of companies taking part in organising the contest, as well as their family members.

The contest shall take place entirely on the social media https://www.instagram.com/cannesyachtingfestival/. No other medium of participation shall be authorised.

 

Participants must be members or followers of the aforementioned Cannes Yachting Festival and Azur Hélicoptère Instagram account.

Only one participant shall be allowed per household (same name and address) during the contest period, otherwise the said participation shall be invalidated. No participant shall be allowed to contest under several pseudonyms or on behalf of other persons.

Any costs and expenses incurred by participants to compete shall remain the sole responsibility of the participants.

 

ARTICLE 3: PROCEDURE

3.1 To take part in the contest, the participant must:

- Follow the @cannesyachtingfestival and @azurhelico Instagram account.

- Take a photograph based on the theme "Sea, Sail & Fun" that evokes yachting.

- Share their photograph on Instagram using the following mandatory references of the contest: @cannesyachtingfestival @azurhelico #yachtingfestival #seasailfun #cyfcontest2021.

- Publish the photograph between 01 August 2021 and 31 August 2021 at 01:00 pm included.

- Identify in the comments section of the Yachting Festival publication two other users then share the advertisement of the contest in their story.

- Gather as many likes, favourites and retweets as possible to increase one's chances of winning.

Participants whose photograph shall be considered offensive, hateful, racist, xenophobic, sexist, homophobic, revisionist, discriminatory, defamatory or pornographic shall be disqualified.

3.2 On Wednesday 8 September 2021, the jury of experts of the Cannes Yachting Festival (RX France) shall meet to choose the winning photograph.

The jury's choice shall be based on the following criteria:

·         Consistency between the photograph and the theme ;

·         Artistic value of the photo composition ;

·         Originality in the photographic creation ;

·         Quality of photography techniques (framing and lighting) ;

·         Additionally, the number of likes, favourites and retweets earned by the photograph.

The results of the contest shall be announced on Wednesday 8 September 2021 in the afternoon on the Cannes Yachting Festival's website and Instagram account used to run the contest.

3.3 PRIZES

The following prizes shall be awarded to winners

A helicopter flight to the Iles de Lérins, subject to the feasibility thereof*.

Flight time: 6 (six) minutes

Flight dates: Possible only between 8 September2021 and 12 September 2021.

Departure from Vieux Port de Cannes heliport with shuttle to pick up the winner from the entrance of the exhibition grounds and drop off him/her at same point after the flight.

Flight to accommodate 3 persons (winner plus 2 other companions of his/her choice).

This is strictly understood. In particular, food and beverage expenses, living expenses and transport are not included in the delivery up to the Vieux Port and remain the exclusive responsibility of the winner.

ARTICLE 4: PRESENTATION OF PRIZE

The organiser shall contact the winner on the Instagram account used by the participant for the contest. The organiser shall notify the winner of the prize and request the latter's e-mail and physical address to be able to contact him/her.

The winner must take the helicopter flight during the Cannes Yachting Festival, namely: between the jury's announcement on Wednesday, 8 September 2021, and the closing of the Yachting Festival, on 12 September 2021.

Failing a response from the winner within 24 hours following the notification of the latter by the jury, the winner's silence shall be considered as an outright relinquishment of the prize. Thereafter, the prize shall revert to RX France that may award it to the runner-up.

The prize shall neither be exchangeable for the same value in cash nor substituted with a prize other.

The prize shall not give rise to any dispute whatsoever by the winner. RX France shall not receive any complaint or claim related to the prize or the manner in which it is awarded.

RX France shall in no manner whatsoever be held liable should the vendor responsible for the helicopter flight not be in a position to execute same.

The winner declares that he/she is fully aware and agrees that the helicopter flight shall be made under the sole and exclusive responsibility of the vendor in charge of same. RX France disclaims any liability, be it contractual or otherwise, for any incidents, damages, accidents or any other inconveniences that may occur during the helicopter flight.

RX France shall not be held liable in any manner whatsoever in case of any direct and/or indirect bodily harm, material and/or immaterial damage that may occur during the helicopter flight or ensuing therefrom.

The winner hereby guarantees that his/her companions during the said flight are fully aware of the aforementioned conditions and agree to same.

RX France shall in no manner whatsoever be held liable should the address provided by the winner during the contest turn out to be inaccurate, incomplete or erroneous.

No message shall be sent to non-winners.

By accepting the prize, the winner shall be authorising RX France to carry out any actions aimed at promoting the outcome of the contest, by disclosing his/her identity, status and credentials.

 

ARTICLE 5: INTELLECTUAL PROPERTY - IMAGE RIGHTS

The winner shall authorise the organising company to use his/her photograph, names and address for advertising campaigns on the contest or the Cannes Yachting Festival without claiming any form of remuneration, right or benefit.

Participants shall guarantee the contest organiser that they are actually the authors of the photograph(s) sent for the contest and that the said photographs shall not infringe on the rights of any third party, or that they have obtained from such third parties the full rights and/or authorisations required.

The organiser shall disclaim any liability in this respect..

Participants declare that they have not ceded or granted the intellectual property rights relative to their photograph(s).

They shall authorise the organiser to publish their names, credentials or photograph(s) for purposes of information or communication on the contest or the Cannes Yachting Festival, without claiming any right or remuneration whatsoever.

They shall equally authorise the organiser to reproduce and utilise free of charge and on any territory whatsoever during the useful life of the rights concerned, their photograph(s) together with any title and description of same that the participants may provide, in promoting the contest and/or Exhibition: communication materials for the contest and Exhibition to advertise both events. When using each photograph, the organiser must mention the names of the author of same.

 

ARTICLE 6: LIMITED LIABILITY

The organiser hereby reminds participants of the characteristics and limitations of the Internet and disclaims any liability for any consequences arising from participants logging onto the same using the contest website.

More especially, the organiser shall not be held liable for any material or immaterial damages suffered by participants, their computer equipment and data stored therein, as well as for any consequences arising from their private, professional or business activities.

Furthermore, the organiser shall not be held liable in case one or several participants are unable to log onto the contest website or unable to participate due to a technical failure or problems arising especially from congestion of the network. The organiser reserves the right to disqualify any participant found guilty of fraud.

In no manner whatsoever shall the number of prizes exceed what has been provided for herein.

Should any participation in the contest contain an irregularity (incomplete or incorrect form, attempted fraud or cheating, etc.), it shall be disqualified.

Where required by circumstances, the organiser reserves the right to shorten, extend, change, suspend, postpone or cancel the contest without any liability whatsoever.

The organiser equally reserves the right to change the prize with a prize of an equivalent or a higher value, where the said prize is unavailable, without this giving rise to any claim or dispute whatsoever.

The organiser further reserves the right to carry out any relevant checks on the identity of participants, including on the veracity of information provided on.

ARTICLE 7: AVAILABILITY OF CONTEST RULES AND REGULATIONS

The Contest Rules and Regulations shall be posted on the Cannes Yachting Festival website.

The organiser reserves the right to change or cancel the contest at any time, without the candidates claiming any form of damage whatsoever as a result.

ARTICLE 8: ACCEPTANCE OF CONTEST RULES AND REGULATIONS

Participation in the contest shall be tantamount to full and unqualified acceptance of these Rules and Regulations. Any difficulties arising from the implementation or interpretation of these Rules and Regulations, including any provisions not made in same, shall be addressed by the Organiser.

Any disputes relative to the contest shall not be addressed after a period of one (1) month effective from the participation deadline mentioned in Article 1.

ARTICLE 9 - AGREEMENT ON PROOF

It is hereby agreed that barring cases of obvious error, the data available in RX information systems shall have evidentiary effect with respect to log-in data and information deriving from computer-processing of the data provided for the contest.

ARTICLE 10: PERSONAL DATA

The personal data collected from the participation forms shall be recorded in a computer file by RX France (52 Quai de Dion Bouton, 92800 Puteaux). They shall be needed to participate in the contest and for any other purposes in line with the RX France Confidentiality Policy.

The mandatory personal data to be provided shall be mentioned on the form. Without these data, RX France shall be unable to admit the candidate into the contest.

The personal data shall be kept for as long as possible to allow candidates to participate in the contest and respond to their queries.

Pursuant to the European Regulations on personal data protection (EU) 2016/679 – GDPR and other data protection acts, participants shall be entitled to access, object to, delete and rectify their personal data by contacting RX France through the following e-mail address: [email protected].

 

ARTICLE 11: APPLICABLE LAW

These Rules and Regulations shall be governed by French law.

ANY DISPUTES RELATED TO ITS INTERPRETATION OR IMPLEMENTATION SHALL BE REFERRED TO THE COMPETENT COURT IN PARIS.
